Noida Goes Tax Free: What Does It Mean? How Will It Affect You?

In a major development to boost growth in the Delhi-NCR region, the Central Board of Direct Taxes (CBDT) recently provided tax exemption to New Okhla Industrial Development Authority (NOIDA). The tax exemption has been provided under Section 10 (46A) of the Income Tax Act.

The Noida tax exemption will come into effect from the assessment year 2024-25. Noida was established under the Uttar Pradesh Industrial Area Development Act, 1976.

Exemption under Section 10 of I-T Act, will ensure that the city is not taxed on income from non-commercial public utility functions. As per the CBDT notification, dated 17 July, NOIDA is exempt from paying income tax on revenue generated through public utility services such as rent, fees, and government grants. However, income from commercial or profit-driven activities remains taxable under existing laws.

There will be no direct impact on residents of the decision, but indirectly, they may get to avail the benefit of better civic amenities due to tax relief. Due to a reduced tax burden the Noida development authorities would be able to allocate more funds towards infrastructure development and other requirements of the area residents. As a result, residents may see better maintenance of roads, housing, transport, and drainage systems without increasing local taxes.

The official gazette notification by the CBDT states: "In exercise of the powers conferred by sub-clause (b) of clause (46A) of section 10 of the Income-tax Act, 1961, the Central Government hereby notifies New Okhla Industrial Development Authority (PAN: AAALN0120A)... for the purposes of the said clause."

Boost To Business In Noida

The development is also likely to give a filip to business opportunities and activities in Noida. The residents may see faster project approvals and improved industrial infrastructure. Eventhough, the tax obligations remain unchanged, there will be streamlining of administrative processes that could make conducting business in the area easier.
A crucial condition accompanies this exemption: NOIDA must maintain transparent financial records that distinctly separate exempt income from taxable income. Adhering to this requirement is essential for continuing to enjoy the tax benefits.
This policy change aims to enhance infrastructure efficiency while ensuring fiscal responsibility is maintained. It represents a significant shift in approach towards supporting development within NOIDA.

Tax exemption to Noida doesn't mean complete removal of tax liabilities. CBDT, in its notice, has clarified that Noida must maintain a separate books for exempt and non-exempt income. There is also a risk of removal of the exemption in case of any overlap or misuse of the exemption.
