The first prize winner will get Rs 1 crore, followed by the second and third prizes of Rs 30 lakh and Rs 5 lakh. There is a consolation prize of Rs 5000, which will be declared in 12 series. Gains in any Kerala lotteries will fall under the income from other sources category, and hence they are taxable. Section 115BB and Section 194B highlight tax provisions on lottery winnings, which are part of the 'income from other sources' category of the Income Tax Act.
In general terms, all individuals in India are taxed on two categories --- firstly, their salaried income per annum --- and secondly, on their gains in 'income from other sources' which can be gains in investment schemes like mutual funds, stocks and much more. Accordingly, gains from selling an asset or winning a lottery ticket are also part of income from other sources.
Hence, the Kerala lottery prizes will face a 30% tax rate, and 4% cess will also be applicable. This brings the effective taxation rate to 31.2%. In the case of the winnings exceeding Rs. 10 lakh, an additional 10% surcharge is also applicable.
How To Claim Kerala Bhagyathara Lottery Prizes?
As per Kerala Lotteries Net, the prize-winner of a lottery shall surrender the prize-winning ticket within 30 days of the draw with all necessary documents. Prizes up to Rs. 1Lakh may be claimed from the District Lottery Offices concerned. Prize-winning tickets above Rs 1 Lakh shall be surrendered before the Director of State Lotteries after affixing the signature, name, and address of the prize winner on the reverse of the tickets with the following documents.
1 A claim application along with a Photostat copy of both sides of the ticket, self-attested.
2 Two passport-size photographs of the prize-winner duly attested by a Gazetted Officer/Notary.
3 A receipt for the prize money in the prescribed form, affixing a revenue stamp worth Rs 1/- with the full address of the prize winner (download).
4 If the prize winner is a minor, a Guardianship certificate from a competent authority.
5 In case of joint claims, one of the prize-winners should be authorised to receive the prize money and a 'Joint Declaration' in stamp paper worth Rs. 50/- should be executed.
6 Self-attested copies of the PAN Card.
7 Attested document to prove identity ( Attested copy of Ration Card, Driving License, Passport, Election ID Card, etc)
